Terms of Service

By creating an account, submitting an application, or accessing any part of the Platform, you represent that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to these Terms and our Privacy Policy.

If you are using the Platform on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms, and "you" refers to that entity.

To access most features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account credentials
• Promptly notify us of unauthorized access at partner@affluencerhub.com
• Accept responsibility for all activity that occurs under your account
• Not share your account with others or create multiple accounts to circumvent restrictions

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Platform or other users.

As a creator on AffluencerHub, you agree to:

• Provide truthful and accurate information about your content, audience, and platforms
• Disclose affiliate relationships in your content in compliance with applicable laws and regulations (e.g., FTC guidelines in the US)
• Only promote products and brands you have permission to promote through the Platform
• Not artificially inflate clicks, impressions, or conversion metrics
• Comply with the terms of any brand campaign you participate in
• Maintain the authenticity and quality standards expected by brand partners

AffluencerHub acts as an intermediary connecting you with brand affiliate programs. We are not responsible for the terms, payment schedules, or performance of individual brand programs beyond what is managed directly through our Platform.

As a brand on AffluencerHub, you agree to:

• Provide accurate information about your products, campaigns, and commission structures
• Honor the commission rates and payment terms agreed upon with creators
• Treat creator partners with respect and professionalism
• Not use creator data obtained through the Platform for purposes outside the agreed campaign scope
• Comply with applicable advertising, consumer protection, and data privacy laws in all campaign markets
• Promptly communicate campaign changes that affect active creator partnerships

Commission rates, payment schedules, attribution windows, and program terms are set by individual brand partners and disclosed to creators before participation. AffluencerHub does not guarantee specific earnings or conversion rates.

Commission payments are processed according to the schedule specified in each program. AffluencerHub may charge a platform service fee as disclosed at the time of your enrollment.

We reserve the right to withhold or reverse commissions for fraudulent activity, policy violations, or returned orders as determined by the brand partner's terms.

You may not use the Platform to:

• Commit fraud, including click fraud, fake orders, or artificial inflation of performance metrics
• Violate any applicable law, regulation, or third-party rights
• Upload, post, or transmit any content that is unlawful, harmful, threatening, or offensive
• Reverse-engineer, scrape, or attempt to extract source code or data from the Platform
• Interfere with or disrupt the integrity or performance of the Platform
• Access the Platform through unauthorized means or circumvent security measures
• Impersonate any person or entity or misrepresent your affiliation
• Solicit other users to move transactions outside the Platform to avoid fees

Violation of these prohibitions may result in immediate account suspension, commission forfeiture, and legal action.

AffluencerHub IP: All Platform software, design, logos, trademarks, AI models, and content created by AffluencerHub are owned by us or our licensors. You may not use our intellectual property without prior written permission.

Your Content: You retain ownership of content you create (posts, videos, captions). By submitting content to the Platform, you grant AffluencerHub a limited, non-exclusive, royalty-free license to display and use that content for Platform operations and marketing with appropriate attribution.

Brand Assets: Brand logos, product images, and campaign materials remain the property of the respective brands and may only be used as authorized within active campaign agreements.

AffluencerHub uses artificial intelligence to provide brand matching recommendations, content suggestions, and performance insights. These are provided as guidance only. We do not guarantee the accuracy, completeness, or fitness of AI-generated recommendations for any particular purpose.

You are solely responsible for reviewing and acting on any AI-generated recommendations. AffluencerHub is not liable for outcomes resulting from decisions made based on AI suggestions.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific earnings, campaign results, or business outcomes.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AFFLUENCERHUB AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

You agree to indemnify, defend, and hold harmless AffluencerHub and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of or inability to use the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Platform.

You may close your account at any time by contacting us. We may suspend or terminate your access to the Platform, with or without notice, for any reason including violation of these Terms, prolonged inactivity, or at our sole discretion.

Upon termination: pending commission payments owed to you will be processed according to the applicable payment schedule; your license to use the Platform terminates; and Sections 7, 9, 10, 11, and 13 of these Terms will survive termination.

These Terms are governed by and construed in accordance with applicable law. Any dispute arising from these Terms or your use of the Platform shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of a recognized arbitration body, except that either party may seek injunctive relief in a court of competent jurisdiction.

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on the Platform at least 14 days before the new Terms take effect. Your continued use of the Platform after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Platform.
